Data privacy notice required by Article 13 of Legislative Decree 196/2003 Moto Guzzi S.p.A. (hereinafter “Moto Guzzi” or “the Company”), with registered offices at 57 Via E.V. Parodi, Mandello del Lario, (LC), Italy, represented by the Data Holder delegated by the Board of Directors and domiciled for legal purposes at the same address, hereby issues the following data privacy notice. Personal details (data) provided by individuals registering as users of this site and/or subscribing to its services or registering for events and promotions advertised through it will be processed by Moto Guzzi, directly or through third parties in compliance with the data privacy and protection requirements established by Legislative Decree 196/2003 and other applicable legislation. The said personal details will be processed by Moto Guzzi: a) in order to provide the services requested, to verify the quality of services provided, and to comply with applicable accounting and taxation legislation; b) only when specific and express permission has been given, for commercial, promotional and marketing purposes, through on-line and off line channels, and for the purposes of market research and statistical studies such as the monitoring of levels of customer satisfaction related to Moto Guzzi products, or the distribution of technical and promotional literature on the products and services offered by Moto Guzzi and/or by its affiliates and/or dealers and/or distributors. Personal details may be divulged to other companies in the Piaggio Group of which Moto Guzzi is a part, and/or to other specialist companies (provided the latter adopt data security and protection measures complying with current legislation) for the same purposes as those for which the details were collected. The granting of authorisation to process personal details for the purposes listed in a) is entirely voluntary, but is required in order to access the services, promotions and offers publicised by Moto Guzzi on its websites from time to time. Moto Guzzi will be unable to provide requested services to individuals choosing not to give such authorisation. The granting of authorisation to process personal details for the purposes listed in b) is entirely voluntary, and failure to do so does not prevent access to website services and promotions. Personal details are processed in compliance with legal requirements, and in complete respect of the law and all other contractual and regulatory requirements. Personal details are processed by means of hard copy and computerised files, using processing logic developed strictly for the purposes listed above and for the purpose of ensuring the security and privacy of the details in question, and also in compliance with the requirements of Articles 31 and following of Legislative Decree 196/2003 and the Technical Regulations of Appendix B of the said decree. Personal details are kept for a period of time no longer than that necessary to fulfil the purposes for which they were gathered and for no longer than the maximum period permitted under civil and fiscal law.Personal details are processed by the Holder, assisted by other individuals acting as Process Managers within or external to the Holder’s own organisation, or by other individuals delegated for the purpose. In particular, personal details may be divulged to the employees and contractors of companies involved in delivering the services offered by Moto Guzzi at any time, and to the employees and contractors of other companies designated as Process Managers and involved as such in marketing or promotional activities on behalf of the Data Holder. Article 7 of Legislative Decree 196/2003 grants specific rights to all individuals providing personal details. In particular individuals have the right to obtain confirmation of whether or not any of their personal details are being held, even if the said details have not yet been finally registered, and to have these details presented in an understandable format. Individuals likewise have the right to be told the source of any such details, as well as the logic, purposes and methods on which their processing is based. They likewise have the right to be told the identity of the Data Holder, Process Manager, and Data Holder’s representative in the country where they reside, and what persons/classes of persons their personal details may be divulged or exposed to as designated representatives, process managers or delegates in the country where they reside. Individuals also have the right to obtain the deletion or anonimisation of their personal details and to block their use in violation of the law, and to have details updated, corrected, and if so required added to. Individuals likewise have the right to receive certification that the need to perform all such operations has been brought to the attention of all those persons to whom the personal details were divulged. Individuals also have the right to halt the processing of their personal details for any legitimate reason. The Process Manager nominated under the terms of Article 29 of Legislative Decree 196/2003, to whom individuals may at any time address requests to exercise the rights established under Article 7 of Legislative Decree 196/2003 is the manager of the Marketing and Communication function at the time of the request.
